2. Definitions

• "Effective Date" - The date these Terms and Conditions take effect, as stated above.
• "Intellectual Property Rights" - All copyrights, trademarks, patents, design rights, database rights, trade secrets, and other intellectual property rights worldwide.
• "Material" - Content submitted to the Website or provided to Global Education Care, including user inquiries, application details, and documents.
• "Registration Details" - Information provided by a User during registration or inquiries, such as name, email address, phone number, and academic records.
• "Service" - Consultancy services for study abroad, including university selection, visa assistance, scholarship guidance, and related support.
• "Unacceptable" - Material that, under applicable laws, is:
  • Illegal, offensive, misleading, defamatory, or infringing third-party rights, including Intellectual Property Rights;
  • In breach of regulations or codes of practice;
  • Likely to harm Global Education Care’s reputation.
• "User" - Any individual or entity using the Website or Service.

3. User Obligations

3.1 Users must provide true, accurate, current, and complete Registration Details and update them as necessary to use the Service.

3.2 Users warrant they are at least 18 years old and legally capable of entering contracts.

3.3 Global Education Care may refuse or remove any Material deemed Unacceptable or inappropriate without notice.

3.5 By submitting Material, Users grant Global Education Care a royalty-free, perpetual, non-exclusive license to use, reproduce, modify, and distribute the Material for providing the Service. Users warrant they have the necessary rights to grant this license.

3.6 Global Education Care may suspend or terminate a User’s access to the Service at its discretion, notifying the User by email. Terminated Users must not attempt to re-engage with the Service directly or indirectly.

4. Service Description

4.2 Global Education Care is not a university or visa authority and does not guarantee admission, visa approval, or scholarships. Outcomes depend on third-party decisions (e.g., universities, immigration authorities).

4.3 Fees for the Service are outlined in separate agreements or communications. Users are responsible for third-party costs (e.g., university fees, visa fees).

5. Data and Cookies

5.1 User Registration Details and Material will be recorded but not disclosed to third parties except as required by law, for Service delivery (e.g., to universities), or in aggregated, anonymized form.

5.2 We use cookies to enhance the user experience and track Website usage. Cookies do not identify Users personally. Users may disable cookies, but this may limit Website functionality.

5.3 Users authorize Global Education Care to use their information for Service-related communications and marketing (e.g., newsletters). Users may opt out by emailing info@gecare.co.uk with “unsubscribe” in the subject line.

6. Intellectual Property

6.1 Global Education Care owns all Intellectual Property Rights in the Website and Service, including design, text, graphics, and their arrangement.

6.3 Users must report suspected Intellectual Property Rights infringements to info@gecare.co.uk. We will investigate and inform relevant authorities if necessary.

7. Limitation of Liability

7.1 Global Education Care is not liable for indirect, consequential, or incidental losses, including loss of profits, opportunities, or data, or for any User’s liability to third parties arising from these Terms.

7.2 We strive to exclude viruses from the Website but cannot guarantee their absence. Users should use appropriate safeguards before downloading content.

7.3 We are not liable for the accuracy or suitability of Material or third-party decisions (e.g., university admissions, visa approvals). Users rely on Material at their own risk.

7.4 We are not liable for Service interruptions or failures due to third-party services.

7.5 These clauses do not restrict liability for death or personal injury caused by our negligence.

7.6 Our maximum aggregate liability for direct losses shall not exceed twice the amount paid by the User to Global Education Care related to the claim.

8. Warranties and Indemnity

8.1 We do not warrant that Website information is accurate, complete, or current. Users rely on such information at their own risk.

8.2 Material is not tailored to individual User needs. Users are responsible for verifying suitability before making decisions.

8.3 All warranties, express or implied, are excluded to the fullest extent permitted by law.

8.4 Users agree to indemnify Global Education Care against all liabilities, claims, and expenses arising from any breach of these Terms.

9. General

9.1 These Terms constitute the entire agreement between the parties, superseding any prior representations, except for fraudulent misrepresentations.

9.2 We may amend these Terms at any time. Changes will be posted with an updated Effective Date. Continued use of the Service constitutes acceptance of the new Terms.

9.3 If any provision is void, it is deemed deleted, and the remaining provisions remain in effect.

9.4 We may assign or subcontract our rights and obligations under these Terms.

9.5 Users may not assign or transfer their rights without our written consent.

9.6 Notices may be served by email to info@gecare.co.uk or the User’s last known email address, deemed received 24 hours after sending.

9.7 We are not liable for delays or failures due to causes beyond our control, including acts of God or governmental regulations.

9.8 Any delay in enforcing these Terms does not waive our rights.

9.9 These Terms are governed by the laws of England and Wales, with the non-exclusive jurisdiction of the courts of England and Wales. We may pursue Intellectual Property Rights enforcement in any relevant jurisdiction.
